Marín Chaparro, Mota Marrero, Peña Palmentieri and Soto Méndez were arrested in different proceedings in March 2018 and were accused in military courts for the alleged crimes of instigating rebellion, against military decorum and treason.
The Third Military Control Court in Caracas only admitted the first two accusations and on December 16, 2020, sentenced them to seven years and two months in prison. His lawyers have filed different appeals, but they were all systematically denied.
The four soldiers have denounced that in their cases not enough evidence was presented to prove the alleged conspiracy in which they are linked. They have also pointed out the various tortures to which they have been subjected in different detention centers, whether they are the basements of the General Directorate of Military Counterintelligence (Igbert Marín Chaparro case) or the National Center for Military Prosecutors (Deibis Mota Marrero case).

The Inter-American Commission on Human Rights (IACHR) has issued precautionary measures in favor of lieutenant colonels Igbert Marín and Deibis Mota for health reasons, but they have been ignored by the Venezuelan State. While the UN Working Group on Arbitrary Detentions has requested the immediate release of Marín Chaparro.
On January 27, Igbert Marín Chaparro ended a 67-day hunger strike after his relatives reported his situation to the United Nations High Commissioner for Human Rights, Volker Türk. A day later, the UN official requested the release of all political prisoners in the country.
