The Criminal Chamber of the Supreme Court of Justice dismissed an appeal that sought to annul the 30-year prison sentence imposed on the Aragua state police officer, Junior José García Tovar, who was found guilty of murdering the police officer, Rosbely Alexandra. Rojas Veloza (20).
Such a decision is found in sentence number 645 written by Judge Elsa Gómez, with the endorsement of her colleagues, Carmen Marisela Castro and Maikel Moreno.
The criminal events occurred on July 10, 2022 inside an apartment located in the Guasimal urbanization, Maracay (Aragua). Junior and Rosbely were going out and that day they went to a party in the aforementioned urbanization. At one point during the evening, Junior took out his service weapon and fired it at Rosbely, who died at the scene. The autopsy protocol indicates that the officer died from a “skull fracture due to severe head trauma.”
As a result of this fact, the Public Ministry requested to open a trial against Junior for the alleged commission of the crimes of aggravated femicide, improper use of an organic weapon and omission of assistance and relief.
The trial was approved and began on April 26, 2023 before the Second Court for Crimes of Violence against Women of the state of Aragua, concluding on December 18, 2023. The aforementioned court sentenced him to the maximum penalty for aggravated femicide and improper use of an organic weapon, absolving him of the crime of omission to help.
On July 10, lawyer Greisis Coromoto Sánchez Vásquez, acting as defender of Junior José, filed an appeal for cassation before the Criminal Chamber, where she denounced, among others, the improper application of the law, since she considers that the officer is guilty of in manslaughter and not femicide, because he accidentally fired the firearm.
The magistrates rejected this approach because the lawyer did not explain what events were proven in the trial to determine that criminal conduct. By dismissing the appeal, the Court confirmed the 30-year sentence imposed on the police officer.
