The Criminal Chamber of the Supreme Court of Justice ratified the sentence of 20 years in prison imposed on the sergeant of the Bolivarian National Guard Noel Gilberto Martínez Márquez (31), accused of aggravated femicide to the degree of frustration, according to sentence 197 drafted by the magistrate Maikel Moreno .
The events occurred on 6/11/17 at the residence of Ivana Jeniree Linares Andrade, located on Avenida Atlántico, Puerto Ordaz, Bolívar. Martínez, who had already separated from Ivana, appeared at the property. The soldier went to ask her for another opportunity but she did not accept, says the sentence.
Within minutes, the woman left the house and went to a friend’s house. Upon returning from her, the soldier attacked her with a machete, leaving injuries to her chest, lumbar region and right buttock.
This fact was denounced before the Cicpc-Ciudad Guayana by Sandra Andrade, mother of the victim. As a result of that complaint, the criminal proceedings against Martínez began, whose trial took place between April 13 and November 22, 2018, the date on which the 1st Trial Court for Violence Against Women of the state of Bolívar, Puerto Ordaz extension, sentenced him. to 20 years in prison. This decision was appealed by the military’s lawyers, who argued that the injuries caused to Ivana did not endanger her life; Hence, they consider the 20-year sentence “exaggerated.”
The Court of Appeals dismissed the appeal and confirmed the conviction, a decision that was later endorsed by the Criminal Chamber of the TSJ, considering that the challengers failed to point out “the legal precept allegedly infringed,” the sentence outlines.
