Marino Alvarado, defender of Human Rights and Lawyer of Prova, reported this Sunday, August 10, that the Supreme Court of Justice (TSJ) did not receive the appeal of Habeas Corpus in favor of activist Martha Lía Grajales, arrested on Friday, August 8 when leaving a concentration in support of the mothers of the post -election prisoners, attacked during a vigil at the headquarters of the Judiciary.
“Yesterday again in the Caracas Criminal Judicial Circuit, they refused to receive an action of habeas corpus action, a pattern of action that violates the Constitution and the Organic Law of Amparo to Freedom and Personal Security,” wrote in his account in X.
Alvarado warned that the refusal to receive habeas corpus can constitute a crime of obstruction to justice “being an arbitrary measure that prevents inquiring about the situation of a person who is at risk of cruel and inhuman treatment and the justice system refuses to act.” In addition, he said, it generates international responsibility because the Inter -American Convention against Forced Disappearance and the International Covenant on Civil and Political Rights are violated.
Prova remembered magistrate Caryslia Rodríguez, president of the TSJ, and Judge Carolina Molinos Romeros, president of the Caracas Criminal Judicial Circuit, “that the reception and admission of the habeas corpus action is not a discretionary act”, but “a right enshrined in Art. 27 of the National Constitution and in articles 2, 3 and 4 of the Organic Law of the Organic Law.
The action was presented by Antonio González, husband of the emerging movement activist, in the company of supply. For more than seven hours they tried to intruduce the resource, but they did not get an answer.

So far, there has been no official pronouncement over the whereabouts of the emerging movement activist. This Saturday diverse National Human Rights Organizations and International issued communiqués condemning the arrest of Grajales and demanding their immediate freedom.
