The two lawsuits admitted against Onapre indicate that the instructions must be declared null because it violates human rights, university autonomy and the progressivity and intangibility of labor rights.
On the afternoon of this Friday, July 15, it was learned that the Political-Administrative Chamber of the Supreme Court of Justice (TSJ) admitted two lawsuits that seek to annul the recent instructions from the National Budget Office (Onapre).
The lawsuits seek to annul this instruction called “adjustment process of the public administration remuneration system, collective agreements, special tables and strategic companies”.
One of the accepted demands was filed by the Central University of Venezuela, Carabobo University, Oriente University, Unexpo and Upel; while the other belongs to the Universidad de Los Andes.
According to what was published by Access to Justice (AJ) the contested instructions contain the criteria for the application of the salary increase decreed by the National Executive in March, whose execution is the responsibility of Onapre and, in the case of universities, the Ministry for University Education.

The plaintiffs point out that the instructions must be declared null because it violates human rights, university autonomy and the progressivity and intangibility of labor rights.
Both demands were admitted, but the amparos to obtain the temporary suspension of the instructions were declared inadmissible.
Protests against the Onapre instructions
On Wednesday, July 12, public sector workers, along with several unions and retirees and pensioners staged a mobilization in the center of Caracas in order to reject the Onapre instruction, demand its repeal and request the homologation of their salaries in accordance with what is the food basket.
While at the beginning of the month the Trade Union Intergremial of the Health Sector public a statement denouncing the delays in payments of premiums and corresponding bonuses for uniforms and recreation, which affects active and retired workers, which have not been canceled due to the cuts made by Onapre and the problems with the Patria system, to which migrated the payment of public workers.
For 13 union organizations, the cuts made by Onapre in its instructions are a “flattening” of the public administration boards won through collective contracts. For three months, health workers and other sectors have been protesting the cuts made to wages.
