Minister Ricardo Lewandowski, from the Superior Electoral Court (TSE), last night (21) granted the first registrations of candidacy for the Presidency of the Republic. The candidacies of vice-presidents Antonio Alves (PCB) and Raquel Tremembé (PSTU) – who make up the slates of Sofia and Vera, respectively – also had their registrations approved.

The validation of the candidacy registration by the TSE is one of the mandatory steps for those who intend to run for the Presidency. In the procedure, the electoral court analyzes whether the documentation presented by the candidate complies with what is required by electoral legislation.

Among the mandatory documents are a declaration of assets and a criminal record certificate. The TSE also assesses whether, on behalf of the candidate, there is any legal impediment, including those provided for in the Clean Record Law. Applicants cannot, for example, have a conviction by a collegiate body of Justice weighing on them.

It is possible that the candidacies have also been challenged (questioned) by the Public Ministry, by an opposing candidate, party or coalition, or even by a citizen. In the cases of Sofia Manzano and Vera Lúcia, “Lewandowski noted that there was no challenge to the registration or news of ineligibility”.

This year, 12 applications for registration of candidacy for the Presidency were made, all submitted to the TSE by the deadline, on August 15th. According to the electoral calendar, court ministers have until September 12 to decide whether to grant or deny the registrations of the other ten candidates.

It is up to the TSE to judge applications for registration only for the Presidency and Vice-Presidency of the Republic. For the other positions, the analysis is carried out by the Regional Electoral Courts (TREs).
