The Superior Electoral Court (TSE) decided today (13) to maintain the individual decision of Minister Benedito Gonçalves who vetoed the use of images of the September 7 celebrations in the electoral propaganda of the candidate for reelection Jair Bolsonaro (PL).
The injunction was unanimously endorsed. The votes were cast by ministers Raul Araújo, Sergio Banhos, Carlos Horbach, Ricardo Lewandowski, Cármen Lúcia and the president, Alexandre de Moraes.
The minister’s decision was made on Saturday (10) and was motivated by an action by the Brasil da Esperança Coalition, which supports the candidacy of Luiz Inácio Lula da Silva. The coalition alleged abuse of political and economic power and misuse of the media.
The campaign of Soraya Thronicke (União) also contested the alleged favoring of the candidacy in the festivities.
When judging the preliminary injunction, the minister prohibited Bolsonaro’s re-election campaign from continuing to use images captured during events held to commemorate the Bicentennial of Independence in Brasília and Rio de Janeiro. For Gonçalves, the use hurt the isonomy between the candidates.
“The use of images of the official celebration in electoral propaganda tends to injure isonomy, as it uses the performance of the head of state, in an occasion inaccessible to any of the other competitors”, he decided.
Before the trial, Bolsonaro’s campaign lawyers asked the TSE to release images captured after the official parade and by their own means. According to the defense, the candidate left the official platform, climbed into a stereo car rented by third parties and took off the presidential sash.
