The plenary of the Superior Electoral Court (TSE) unanimously granted the registration of Ciro Gomes (PDT) to the Presidency of the Republic today (1st). The vice of the plate, Ana Paula Matos (PDT), also had the registration confirmed.
The ministers rejected a challenge to the candidacy, presented by councilor Fernando Holiday, from São Paulo. He argued that Ciro Gomes has a conviction for racial slur in the first instance, which would disqualify him from being a candidate for “inadequacy of his previous life”.
Holiday referred to the case in which Ciro called him “captain of the bush”, in a 2018 speech. The pedestrian was sentenced in the civil sphere of Justice of São Paulo to pay compensation to the councilor.

Ciro Gomes’ defense accused the councilor of bad faith litigation and maintained that the challenge has only media objectives, with no intention of succeeding. This is because there is no provision in the Clean Record Law or other legislation that a conviction in the civil sphere can prevent candidacies, the defense stressed.
The Deputy Electoral Attorney General, Paulo Gonet, highlighted that the TSE itself has a summary to say that the concept of “inadequacy of previous life”, provided for in the Constitution, cannot be applied without the reason for such inadequacy being provided in complementary law.
Also citing the summary, the rapporteur at the TSE, Minister Carlos Horbach, voted to deny the challenge and grant the registration of Ciro Gomes’ candidacy. All the other ministers followed the rapporteur without commenting.
The TSE has until September 12 to judge all applications for registration of candidacies to the Presidency of the Republic. So far, only one of the 12 that were presented was denied by the plenary, that of Roberto Jefferson (PTB).
