The Superior Electoral Court (TSE) determined the convening of new elections for mayor and vice mayor of the municipality of Divisa Alegre, in the north of Minas Gerais. It is up to the Regional Electoral Court of the state (TRE-MG) to carry out a new election.
Unanimously, in a session this Tuesday (10), the collegiate confirmed the cancellation of the registration of Reinilda Pereira de Sousa e Silva (PL), the most voted candidate for the city hall in 2020.
According to information from the TSE, the plenary followed the vote of the rapporteur, Minister Carlos Horbach, who rejected Reinilda’s registration due to the late replacement of the candidate Célia das Virgens.
Célia das Virgens had her candidacy registration application rejected on October 27, 2020. On October 28, two days after the deadline, the coalition presented Reinilda Pereira as a substitute candidate.
When voting, the minister highlighted that, both in majority and proportional elections, the replacement will only take effect if the new request is presented up to 20 days before the election. The exception occurs in the event of the death of a candidate, “a fact not characterized in the specific case, regardless of whether the candidate was victorious at the polls”.
According to the TSE, since April 8, the city hall of Divisa Alegre has been temporarily occupied by the president of the City Council. He will remain in office until the candidates who are elected in the supplementary elections are sworn in.
The Court determined immediate compliance with the judgment, regardless of publication.
