The Superior Electoral Court (TSE) ruled on Thursday (7) that the next nominations to the Rio de Janeiro Regional Electoral Court (TRE-RJ) should be made by triple list formed only by lawyers.
The issue was decided after the TSE approved this morning a list of men only for the succession of electoral judge Fernando Marques de Campos Cabral Filho.
The names were referred by TRE-RJ, to the seal of the Superior Court, and will be sent to President Luiz Inacio Lula da Silva, responsible for appointments to the chairs of the electoral courts.
In analyzing the case, the ministers understood that gender alternation should be applied in the next nominationsas determined by TSE Resolution 23,746. According to the standard, the triplices for filling vacancies in the Electoral Court should be composed of men and women, aiming to match the percentage of gender.
Gender equity
In May, The Federal Supreme Court (STF) sent President Lula the first triple list formed only by women candidates for the position of effective TSE minister. From it, the president appointed lawyer Estela Aranha, who took office on Tuesday (5).
During the session in which the list was approved, Minister Cármen Lúcia, who also holds the position of president of the TSE, said that The exclusive list of women is necessary to promote gender parity in the judiciary and prevent the court from being formed by men only from next year, when the presidential elections will be held. In August 2026, amid the election, the minister will leave the court after complying with a two -year term.
“If today a new STF minister came to this plenary and she was under 60, she would take 15 years for the next president of the TSE to be a woman. It will take at least a decade and a half for us to have a woman again in the TSE. Just to get an idea of a woman’s difficulty to take to these positions,” he said.
