The Superior Administrative Court (TSA) ordered, by judgment, the General Directorate of Budget (Digepres) replace the journalist Bernardo Nunez in his position as head of the Department of Communications, the high court reported this Sunday.
According to a press release, the court established that Núñez’s dismissal was carried out in an “irregular” manner and in violation of his status as a career public servant.
Through judgment number 0030-1646-2021, the Seventh Liquidating Chamber of the TSA, also ordered the entity to pay the journalist the salaries and incentives he had not received since “his irregular dismissal.” He did not specify the date.
Judges Úrsula J. Carrasco Márquez, presiding judge; Ana Magnolia Méndez Cabrera, alternate, and Willys de Jesús Núñez Mejía, titular judge, established that Núñez’s due process, contemplated in Law 41-08 of Public Function, was violated.
“The proven omissions constitute, as alleged, the recurring violation of the due disciplinary process enshrined in article 87 of 41-08 on public function; that since the quality of a career public servant is an undisputed fact, this collegiate proceeds to accept the appeal filed, arranging for his reinstatement under the same salary conditions and paying the salaries and incentives not received since his irregular dismissal “, detailed the sentence.
At the time of his dismissal, the journalist Bernardo had been working for 11 years in the General Directorate of Budget and 20 as a public servant, the press release indicated.
