The US State Department posted on social networks a message with new criticism of the Supreme Court Minister (STF), Alexandre de Moraes.
The attack occurs after the decision of Minister Flávio Dino, STF, that foreign laws should not have immediate effects in Brazil. Furthermore, Moraes, rapporteur of actions on a coup plot, said “There is no possibility of retreating even a millimeter” in the case in an interview with the American newspaper The Washington Post.
“Alexandre de Moraes is toxic to all companies and legitimate individuals seeking access to the US and their markets. No foreign courts can invalidate US sanctions-or save someone from the serious consequences of violating them,” said the Bureau of Western Hemisphere affairs.
The Trump government office has reiterated that US people are prohibited from making transactions with Moraes. “And people outside the US should act with caution: those who provide material support to human rights violators face risk of sanctions,” the note added.

DINO DECISION
This Monday (18), Dino He considered that following foreign laws may be under penalty of violation of national sovereignty.
The minister understood that judicial decisions and foreign laws cannot have effects in Brazil without prior analysis by the competent Brazilian authority, under penalty of violation of national sovereignty. By the decision, no law, judicial decision or foreign executive order can produce automatic effects on natural persons, companies or bodies that act in the national territory, or on signed contracts or assets that are in Brazil, without analysis or approval by a competent Brazilian judicial body.
The decision was issued in an action opened by the Brazilian Mining Institute (IBRAM), which fired the Supreme against Brazilian municipalities that opened actions directly in the United Kingdom, in cases against British mining companies, for example.
The minister wrote that any violation of this determination “constitutes an offense to national sovereignty, public order and morals, therefore the ineffectiveness of such laws, acts and sentences emanating from a foreign country is presumed.”

In a rare interview on the case granted to international correspondents Marina Dias and Terrence McCoy, from the American newspaper The Washington Post, Alexandre de Moraes stated “there was no possibility of retreating even a millimeter” in the process.
“Let’s do what is right: we will receive the complaint, analyze the evidence, and anyone who has to be convicted will be convicted, and anyone who has to be acquitted will be acquitted,” Moraes said, according to the interview published in English.
The newspaper describes Moraes as someone used to great clashes with the powerful, in which he assumes with personal posture the maxim “never give up, always advance.”
