The version that the noncommissioned officer Luis Magellan He fired a defensive shot that hit Eduardo Ruiz Sanz by a rebound mechanism, has been supported by an expert report from the Public Ministry.
The General Commander of the National Police of Peru (PNP), Óscar Arriola, recently declared that the release of Magallanes was “almost imminent”, because the shot was negligent, carried out under “insurmountable fear”, and that an initial ballistic examination had already shown that the projectile hit the ground.
CONCLUSIONS OF THE EXPERT EXAMINATION
The forensic ballistics expert report, issued on October 20, 2025 by expert Walter Cubas Rentería, establishes specific conclusions about the body of Eduardo Mauricio Ruiz Sanz. This document was requested by the Third Supraprovincial Criminal Prosecutor’s Office Specialized in Human Rights and Interculturality of Lima.
According to the report, the entry hole in Ruiz Sanz’s chest was caused by a fragment of the core of a projectile, compatible with a “rebound entry” wound.
Furthermore, they indicate that the shot was fired with a firearm of approximately 9 mm caliber. “The anatomical trajectory was from front to back, from left to right and slightly from bottom to top,” the letter reads.
The wound would not present characteristics of a shot at close range (it being less than 50 cm), the expert explains.
In that sense, they indicate that the sample extracted from the body is “a fragment of deformed lead with loss of material, weighing 4.84 grams.” The expert concludes that the shape of the sample indicates that it is part of a projectile that, in its trajectory, collides, “fractures and is projected into parts.”
The defense of non-commissioned officer Luis Magallanes will base his defense on the results of this expert report, pointing out that he shoots in legitimate defense. The expert report was received at the Expert Assessment Office of the Public Ministry of Lima.
