The Regional Electoral Court of São Paulo (TRE-SP) summarized for the third time, yesterday (14), the results of the 2022 Elections for the position of state deputy. With the measure, Antônio Dirceu Dalben (PSDB/Citizenship Federation) became elected, while Edson Giriboni lost his seat, becoming the first alternate. The procedure was necessary after the unanimous decision of the Superior Electoral Court (TSE) to grant the registration of Dalben’s candidacy.
According to TRE-SP, Dalben had his candidacy registration application rejected on September 19, because he was ineligible due to convictions for administrative impropriety in three public civil actions regarding the hiring of construction companies when he was mayor of Sumaré (SP).

He also failed to present criminal certificates that would clarify a procedural situation. “He ran sub judice (under judgment), a situation in which his vote (93,397 votes) was not considered for the definition of those elected, and appealed to the TSE”, said TRE-SP.
The court explained that a decision of December 6 removed the conditions of ineligibility and granted the registration of the candidacy, because supervening legal amendments were presented alluding to three convictions for administrative impropriety, which had their effects suspended by decisions of the Superior Court of Justice (STJ ).
