The Regional Electoral Court of São Paulo (TRE-SP) revoked the diploma of Federal Deputy of Carla Zambelli (PL) and also made it ineligible for eight years from the election of 2022. The decision, made in session held on Thursday (30), occurred by majority of votes (5×2) of the judges.
According to TRE-SP, the federal deputy committed misuse of the media and the practice of abuse of political power. The action was filed by also federal deputy Sâmia Bomfim (PSOL), claiming that Zambelli released untrue information about the electoral process of 2022.
In a statement, TRE-SP stated that, according to the winning vote of Judge Encinas Manfré, rapporteur of the case, the parliamentarian made publications to provoke the discredit of the electoral system and the dissemination of untrue facts.
The magistrate highlighted publications of the deputy with attacks on ministers of the Federal Supreme Court (STF) and the Brazilian electoral system, such as the dissemination, by the parliamentarian, of a false news of manipulation of the electronic ballot box in Itapeva, in the interior of the state.
“It is not too much to recognize that the conduct of the represented reached repercussions and severity able to influence the voter’s free and conscious will and to the detriment of the isonomy of the electoral dispute. Therefore, realities justifying the revocation of the diploma of federal deputy and the declaration of ineligibility, sanctions imposed on it for the practice of abuse of political power and misuse of the media, ”said the judge in his vote.
The deputy may appeal the decision to the Superior Electoral Court (TSE).
In a statement, published on social networks, the federal deputy said she will file appeals applicable to the decision. “Today, TRE-SP understood by nullifying the votes of 946,244 citizens from São Paulo and to revoke my mandate of federal deputy. This decision has no immediate effects, and I will continue to represent São Paulo and my voters until the end of appropriate resources. ”
The deputy also said that she is being politically pursued. “It is clear that (sic) political persecution in our country, against conservatives, is visible as the midday sun.”
