Reform to open the beaches
At the beginning of the month, the Chamber of Deputies unanimously approved the ruling that guarantees free, free and permanent access to the maritime beaches and the federal maritime-terrestrial zone of the country, as well as to the protected natural areas, which seeks to avoid undue restrictions and reinforce the citizen’s right to enjoy these spaces.
The document, which reforms the general laws of National Assets and Ecological Balance and Environmental Protection, was endorsed with 465 votes in favor in general, 470 in particular and was sent to the Senate for analysis.
With this reform, a National Registry of Beach Access is created, under the responsibility of the Secretary of the Environment and Natural Resources (Semarnat) and in coordination with the municipalities. This registry will identify and guarantee access from public roads, which must be safe and signposted.
Municipalities and states must register these accesses in cadastres and public registries to ensure their permanence and prevent blockages during sales or changes in adjacent properties.
It also establishes a prohibition on imposing charges, quotas or restrictive conditions to enter beaches and federal maritime-terrestrial zones. In such a way that exceptions will only be allowed in cases of environmental protection, public safety or national interest.
