Tomás Gálvez removed Germán Juárez Atoche from the Lava Jato Special Team

Through the Resolution of the Prosecutor’s Office of the Nation No. 3680-2025-MP-FN, published yesterday in the official newspaper El Peruano, the acting Prosecutor of the Nation, Tomas Galvezremoved the prosecutor Germán Juárez Atoche of the Lava Jato Special Team and ordered that he be appointed as provisional senior prosecutor of Central Lima, in charge of the Third National Superior Prosecutor’s Office Specialized in Money Laundering Crimes.

The new position she will occupy was led by prosecutor Elizabeth Peralta Santur, who has been in preventive detention since December 3, 2024 within the framework of the investigations of the Andrés Hurtado ‘Chibolín’ case for the alleged crime of influence peddling and specific passive bribery. He is accused of having managed the irregular return of a seized shipment of gold, after alleged bribes equivalent to US$ 1 million. Furthermore, the document recalls that, in October of this year, the National Control Authority (ANC) of the institution decided to remove her from the entity for 3 months.

The resolution also indicates that the legal situation of Peralta Santur “prevents her from assuming and exercising the functions of her position, rendering an administrative act that designates her ineffective and unenforceable, therefore, any designation inherent to her position must be suspended until her legal situation is resolved and the material impediment with respect to the exercise of the fiscal function is resolved.”

The appointment of Juárez Atoche to replace Peralta Santur must be notified to the National Board of Justice (JNJ), the Supreme Court, the Presidency of the Board of Superior Prosecutors of the Lima Central Fiscal District, the National Coordination of the Prosecutor’s Offices Specialized in Money Laundering Crimes and the coordinator of the Special Team of Prosecutors, Rafael Vela Barba.

Peru21 He learned that the Lava Jato Special Team was already aware of the removal of Juárez Atoche and that they agreed with his promotion as senior prosecutor. However, the sources did not rule out that this is a maneuver by the acting Attorney General to weaken, divide and request the deactivation of the team before the Board of Supreme Prosecutors.

During his work as part of the Lava Jato Special Team, Juárez Atoche got the Judiciary to accept the tax charges against former presidents Ollanta Humala and Martín Vizcarra, as well as against the former first lady, Nadine Heredia.

In April of this year, Humala and Heredia were sentenced to 15 years in prison for the contributions of Odebrecht and the government of Venezuela to the 2006 and 2011 presidential campaigns, after it was proven that they committed the crime of aggravated money laundering.

While Vizcarra was sentenced to 14 years in prison for having committed the crime of passive bribery in the Lomas de Ilo and Hospital de Moquegua cases, for having received S/2.3 million in bribes from the companies Obrainsa and ICCGSA when he was governor of the Moquegua region.

Most of the cases led by Juárez Atoche are already in the intermediate stage, under prosecution control. One of them, the most complex, is the one carried out against the so-called Construction Club, where Juárez requested sentences of between 8 and 28 years for businessmen and officials, and 14 companies are included.

He was also leading the investigations of the Vía Evitamiento Cusco case, which was in the preparatory investigation stage, and where former officials of the imperial city are accused.

From now on, the Lava Jato Special Team must evaluate and make a replacement proposal for Juárez Atoche, which must be accepted by Tomás Gálvez.
