The Brazilian justice will hold a new day of the trial of Juan Darthés, accused of “aggravated rape” against Thelma Fardin, in which it is expected that, in addition to the witnesses cited, the actor himself will provide his testimony of the events that occurred in Nicaragua .
This Thursday afternoon, the trial of Juan Rafael Pacífico Dabul – Darthés’ real name – was resumed, which began on November 30 with Fardin’s statement of more than four hours and continued the following day with the testimony of Calu Rivero, days after which the justice of that country entered a recess due to a judicial fair.
It is expected that during the day this Thursday witnesses from both parties will testify, including Anita Co, an actress who in 2018 denounced Darthés for sexual abuse from social networks, an event that allegedly occurred while both were filming the television series Gasoleros.
The group of Argentine Actresses who have accompanied Fardin since the day he publicly denounced the actor specified through a statement that this Thursday “the accused and his wife” will testify.

According to Martín Arias Duval, Fardin’s lawyer, “after the statements of the witnesses, we estimate that Darthés’s, who up to now has not spoken about the events that occurred in Nicaragua, will make the statement,” and recalled that “the justice (of Brazil ) ordered the secrecy (secret) of the case, so we do not have many certainties”.
In this sense, Arias Duval specified that “in the first instance” both he and his client were “authorized to witness” the entire process, but that the 57-year-old actor’s lawyer filed an appeal so that they could not do so and “the judge He accepted it. I guess to prevent the defense from later raising any objections to it.”
Once the declaration stage is over, which according to the lawyer representing the 29-year-old actress, may take longer than expected, it will be the judge of the case, Ali Mazloum, who will determine how the judicial process continues.
In 2018, Fardin, together with the Actrices Argentinas collective, made a public complaint through a video in which he recounted in the first person the events that occurred during a tour that the cast of the fiction Patito Feo made in 2009 in Nicaragua.
“According to the Brazilian criminal procedure system, the parties (Darthés’ prosecution and defense) can be given a period of time to prepare their arguments and can arrange for them to be produced in writing or verbally in a new hearing,” explained the representative. of Fardin.
Darthés faces a maximum sentence of 12 years in prison for the crime of “aggravated rape”, according to Brazilian legislation, which corresponds to the title of “sexual abuse with carnal access”, the lawyer specified, adding that they do not believe “that the sentence takes a long time, at least not in the first instance”.
“It is likely that, if found guilty, the defense will appeal the resolution, otherwise it will be the prosecution that does so, that is why we are talking about a sentence in the first instance,” explained Arias Duval, and recalled that in the event of having to comply some sentence “must be made effective in Brazil”.
The actress accused the actor of having abused her, who at that time was 16 years old and he was 45, consequently the Nicaraguan justice issued an international alert for the arrest of the actor

Arias Duval specified that Brazil does not “extradite its citizens, but it does judge them for events that have occurred” in other nations, which is why the criminal process is carried out in that country, but with the articulation of the Public Prosecutor’s Office of Nicaragua, where the complaint is filed, and Argentina, which has the means to certify the trial processes such as statements virtually, verify identities and that said acts are carried out with the corresponding guarantees.
