Judge Daniele Lima Pires Barbosa converted the arrest in flagrante delicto of the couple Marcos Vinicius Lino de Lima and Patrícia André Ribeiro into preventive action. The two were indicted for the death of the girl Kenya Gabriela Oliveira Matos, 2 years old, on suspicion of mistreatment.
According to a note from the Court of Justice of Rio de Janeiro (TJRJ), the magistrate’s decision was announced during the custody hearing held this Saturday (11) at the Central de Audiências de Custódia de Benfica, in the north zone of Rio de Janeiro. . The girl was Marcos’s daughter and Patrícia’s stepdaughter.
The couple was arrested red-handed on Thursday (9), at the Hans Jurgen Fernando Dohmann Family Clinic, in Guaratiba, west of the city, where, according to the TJRJ, the child arrived lifeless.
The doctor Ana Cláudia Regert, who treated Kenya, still tried to carry out the resuscitation procedures, but the team members found that the child had already been dead for over an hour. The denunciation of the girl’s death and mistreatment, which resulted in the couple’s arrest in the act, was made by the doctor herself at the 47th DP, Guaratiba, which is close to the hospital, where the two still remained.
“According to the police report, based on information from the medical team, the child had 59 injuries compatible with physical aggression and one due to a burn in the navel region, in addition to an anal laceration and a distended abdomen,” the Court said in the note, adding that according to witness reports, “some of the injuries were old, indicating that the child had been suffering torture for some time”.

“Therefore, it is demonstrated the sadistic and vile behavior against a young child and the absolute inadequacy of those in custody for life in society, which makes evident the need to convert prison in flagrante delicto into preventive, as a means of guaranteeing the public order, imposing the action of the Judiciary, even if of a precautionary nature, to restore social peace concretely violated by the conduct of those in custody”.
In testimony to the Police, the couple denied the practice of mistreatment of the girl.
