“Once the Title 42 order expires, the (Department of Homeland Security, DHS) will process persons apprehended at the border who do not have proper travel documents using the powers it has long had under Title 42. Title 8, which provide for significant consequences, including a five-year re-entry ban on people who are expelled,” he said.
The health measure, which also served immigration purposes (Title 42), was drawn up in the Donald Trump administration. Given the rebound in covid-19 infections, the United States government determined to close the asylum system of that nation.
“(Ordered) the suspension of the right to bring persons into the United States from designated foreign countries or places for public health purposes (…) The suspension means the temporary cessation of the effect of any law, rule, decree or order in under which a person may have the right to be introduced or request introduction into the United States,” the mandate established.
The United States government is concerned about the reactivation of the migratory flow, which it has described as the second largest in history, only after World War II:
