The Superior Electoral Court (TSE) started today (26) the judgment of two actions that ask for the revocation of the winning slate of the 2018 elections, formed by President Jair Bolsonaro and Vice President, Hamilton Mourão.
So far, three of the seven justices of the Court have voted against the impeachment. After the demonstrations, the trial was suspended and will resume on Thursday (28), at 9 am.
The Electoral Court began the judgment of two actions filed by the coalition that was formed by PT, PCdoB and PROS. The subtitles call for the repeal of the ticket formed by Bolsonaro and Mourão for allegedly committing abuse of economic power and misuse of the media. According to the parties, the illegal boosting of messages by WhatsApp occurred during the 2018 election campaign.
The vote of the rapporteur, Minister Luís Felipe Salomão, is prevailing. The minister acknowledged that the tool was used to “unduly undermine opposing candidacies”, but said that there is a lack of evidence on the scope of the shots and the repercussions for voters.
“There are no elements that allow us to safely affirm the seriousness of the facts, an essential requirement for characterizing the abuse of economic power and the misuse of the means of social communication”, said the rapporteur.
The understanding was followed by ministers Mauro Campbell and Sérgio Banhos.
Defense
During the trial, lawyer Karina Kufa, representative of Bolsonaro, said that the accusations were based only on journalistic reports and that no evidence was presented that was related to the actions of the campaign.
“Based on everything that is in the records and the proof that nothing was done by the campaign of Jair Messias Bolsonaro and Hamilton Mourão, we are claiming the dismissal of the actions”, he said.
Karina Fidelix, representative of Mourão, also reinforced the lack of proof of the accusations. According to the lawyer, “there was no evidence of abuse of economic power or abuse of the media by the investigated”.
