This noon, the Supreme Court is in session to renew its presidency

This noon will begin the session in which the 11 members of the Supreme Court of Justice of the Nation (SCJN) will elect who will be their president, for the next four years.

The session will be chaired by Luis María Aguilar Morales, in his capacity as dean minister, since Arturo Zaldívar formally left any responsibility for the position at the last minute of December 31.

The procedure for the election is regulated by the Internal Regulations of the SCJN, in force since June 2013.

Article 30 of this rule states that the dean minister at all times will be in charge of directing and monitoring compliance with the procedure established in these Internal Regulations.

The regulation does not contemplate any provision on the possibility that any of the candidates for the presidency incur in a situation that leads to their illegibility, as could be the case of Minister Yasmín Esquivel Mossa, who is accused of having plagiarized your thesis of degree.

no legal basis

Without a firm decision from the UNAM on the signaling, the ministers of the SCJN will have no legal basis to make a decision on this issue, and their only possibility to express their opinion will be their own vote.

Due to the anti-covid measures that remain in force in the highest court, there will be no public in the plenary room during the session; however, its development can be followed live, on the website https://www.scjn.gob.mxor on the cable television channel Justicia Tv, which is managed by the Court.

At the beginning of the session, Aguilar will appoint two scrutineers from among his plenary companions. The votes will be secret, through ballots where the names of the five candidates will be printed: Yasmín Esquivel Mossa, Alfredo Gutiérrez Ortiz Mena, Javier Laynez Potisek, Alberto Pérez Dayán and Norma Lucía Piña Hernández.

If in the first round no candidate achieves a minimum of six votes, more ballots will be printed only with the names of those who have the most votes, repeating the method until there is a winner.
