He Permanent Attention Court of San Francisco de Macorís, in the Duarte province, will learn this Monday the request for coercive measure against the young woman Ankelsi Valerioaccused of causing the shooting death of her 13-year-old younger sister, during an event that occurred in the Taína sector, while the defense and the Public Ministry They maintain conflicting positions on the existence of plaintiffs in the process.
The hearing, initially held last Saturday, was postponed to allow the parties to complete the knowledge of the record and guarantee due process, as ordered by the court.
At the end of the hearing, the defendant’s lawyer, Freddy Faña, assured that up to now there is no person formally constituted as a plaintiff within the record.
He indicated that he has not been notified of any complaint and that, in accordance with criminal procedurethis must be formalized through the constitution in civil actor.
“He record has not yet been delivered to me and there is no record of formally constituted plaintiffs,” stated the lawyer, who added that in the process they appear as possible victims the parents of the minor deceased and another person who was injured and remains hospitalized.
Faña reiterated that, according to his version, the incident occurred without intention of causing the death of the deceased, alleging that his client acted in a context of violence prior.
In contrast, the chief prosecutor of the Duarte province, Smaily Rodríguez, stated that the father of the minor deceased presented a formal complaint before the authoritieswhich initiates criminal action. He explained that the complaint and the complaint are different figures within the process.
“The complaint formalizes the criminal action. The complaint is a civil act and does not condition the progress of the process,” the judge said, emphasizing that it is a fact of public action.
Rodríguez indicated that the case progresses regardless of the constitution of plaintiffs and confirmed that the investigations continue in progress.
The incident occurred on the night of Wednesday January 28when the minor lost her life after receiving a gunshot, allegedly fired by her sister.
After the event, the accused voluntarily surrendered to the authorities and remains in custody.
