Judge Juan Carlos Checkley, in charge of resolving the request, would have a conflict of interest when being investigated by a prosecutor who is trying to close the case.
Armor? The judge Emma Benavides, sister of the current prosecutor of the Nation, Patricia Benavides, would be being shielded by the institution after the supreme prosecutor, Uriel Terán, will request the Judiciary to archive the investigation against him for the alleged crimes of specific passive bribery and illicit association to commit a crime, as he is linked to the alleged collection of bribes from those investigated for drug trafficking in exchange for their freedom.
According to a report published by IDL-Reporteros, Uriel Teran argued that there would be no “elements of conviction” in the preparatory investigation against Emma Benavides, who would have varied the measure of preventive detention by appearance in favor of those investigated for illicit drug trafficking, among which is the Colombian Roberto Gomez Herrera, aka ‘Huevo’ and the Peruvian Jose Manuel Lopez Quispe, aka ‘Daddy’.
The aforementioned media maintains that the prosecutor Uriel Teran it would be undermining “a case that had solid evidentiary foundations” against Enma Benavides. The investigation, points out IDL, has evidence that includes the statement of an effective collaborator who recounted how the judges operated, including Emma Benavides, in favor of drug traffickers.
Among the evidence was what was said by Percy Coromoto Matos, a member of the group led by drug trafficker Roberto Gómez ‘Huevo’, who told Bersabeth Revilla —prosecutor who was removed from the case by Patricia Benavides— how Enma Benavides operated to make “the arrangements” in favor of the freedom of those investigated.
According to the prosecutor’s thesis, “Huevo” gave $150,000 to Walter Mendoza, an intermediary lawyer, in exchange for his freedom. Said money, according to the report, was to pay first instance judge Rafael Martínez and the three magistrates (one of them was Emma Benavides) of Collegiate E of the National Criminal Chamber.
Said information had to be corroborated by the drug trafficker ‘Huevo’ himself, who is serving a sentence in a Brazilian prison. Nevertheless, the same prosecutor Uriel Terán requested the file of the case “before the Brazilian authorities responded to a request for international cooperation sent several months ago to question him.”
Likewise, according to IDL, Terán demanded that the prosecutor Ronald Quispe Suarez, Manager the investigation of Enma Benavides in the Public Ministry, to archive the case, which would also exonerate those investigated.
Judge who will resolve the file has a conflict of interest
the supreme judge Juan Carlos Checkley would have a conflict of interest when appointed to resolve the filing of the tax file against Enma Benavides.
This is because the prosecutor Uriel Teran would be in charge of an investigation against Checkley, being linked by an effective collaborator in the case ‘Los illegales de Piura’, a network of high magistrates accused of receiving bribes in exchange for giving benefits to those investigated and convicted of various crimes.
In addition, it was learned that until September 2022 the investigation against the supreme judge was still ongoing and that it would be Terán who ordered the confidentiality of the case to be lifted in April of that year and, at the same time, to notify the Checkley.
