They warn that Guevara brothers may be excluded from amnesty: “They did not commit murder”

Relatives of Rolando, Otoniel and Juan Guevara warned that they could be excluded from the general amnesty process, announced by Delcy Rodríguez. They reiterated that they are not involved in the death of Danilo Anderson, the prosecutor murdered on November 18, 2004.

«We express our deep concern by confirming that the Guevara brothers intend to be excluded from this process. President Rodríguez pointed out homicide as a crime excepted from the amnesty; precisely the charge for which our relatives were fraudulently sentenced in relation to the case of prosecutor Danilo Anderson,” pointed out the lawyer Jackeline Sandoval, wife of Rolando Guevara, on social networks.

In his announcement, Rodríguez said that “those prosecuted or convicted of homicide, drug trafficking, corruption or serious human rights violations” will be excepted.

The lawyer recalled that the Guevara brothers have been “deliberately relegated from all negotiation and release processes” since 2007, which is why she asked for “freedom and justice” for the former police officers.

Likewise, he pointed out that a ruling from the Inter-American Court of Human Rights requires his release and is of “strict and mandatory compliance, above any discretionary interpretation.”

«We reiterate that they did not commit the murder of Danilo Anderson. His stay in prison is an extension of the injustice that the closure of El Helicoide itself aims, in theory, to remedy,” Sandoval reaffirmed.

Rolando and Otoniel Guevara were sentenced to 27 years in prison for homicide qualified with premeditation and treachery, while Juan Guevara was sentenced to 30 years in prison for the same crime and also for illegal possession of weapons.

The Inter-American Court found that state agents detained the Guevaras on November 20 and 23, 2004. Juan Bautista was disappeared for eight days, and Rolando de Jesús and Otoniel José were disappeared for three days, during which time the authorities did not recognize their detention or report on their whereabouts.

During those days of disappearance, the former police officers were subjected to acts of physical and psychological torture, such as remaining tied in vehicles for long hours; being taken to places where they were stripped of their clothes and beaten in different parts of the body; being suffocated with plastic bags; receiving electric shocks in different parts of the body; being thrown on mats while police officers sat on their backs, and being threatened with torture and depriving their relatives of their lives, the Inter-American Court detailed.

The Guevara brothers were detained in the Sebin Helicoide, until their transfer on August 3 of last year to the Rodeo I maximum security prison, located in the state of Miranda.

Jackeline Sandoval called on the authorities “to act coherently, abide by international rulings and put an end to more than two decades of injustice. “There can be no real amnesty or closure of a dark period if the oldest political prisoners in the country remain forgotten.”
