They urge clear rules to terminate rental contracts and evictions

Affirms that an equitable eviction law is crucial to reduce the housing deficit and foster a favorable environment for landlords and tenants

The Dominican Association of Housing Builders and Developers (Acoprovi) urged to convert the proposal of Rental Law and the rental market in a project that regulates the eviction and termination of a rental contract in the event of eventualities or agreement between the parties, so that there is legal certainty and it is done in a fair and balanced manner.

They stated that it is in the termination of the contract and in the eviction where the weaknesses and problems arise today.

The entity stated that if there are clear and equitable rules, the construction of rental housing would increase, impacting the reduction of the housing deficit and promoting a favorable environment for owners and tenants.

The directors of Acoprovi explained that a rental is an agreement between the parties and the Civil Code already contemplates everything necessary to establish a contract.

But what does not exist are clear and precise rules if some of the parties want to terminate the rental contract or if they breach the agreement, or that contemplate the corresponding compensation to avoid abusive evictions. For this reason, they urge the creation of legal regulations that, observing the rights of the owner and the tenant, terminate the contract and address cases of eviction.

The president of Acoprovi, Annerys Melendez He explained that the suggestions and observations made to this piece of legislation are based on the experience of Peru and sector experts who have advised the entity.

He explained that that country eliminated the rental law and approved an eviction law and this has revolutionized the sector. “Affordable housing is needed, access to decent housing is not only through purchasing, but also through renting.

Then the conditions would be met so that people who live in the peripheries or in insecurity can rent, but at an economical rent,” he expressed when participating in the TODAY’S Economic Meetingalong with Guido Rosario, first vice president, and Santiago Colomé, third vice president.

Rosario expressed that currently neither banks nor investment funds finance projects for renting housing due to the legal insecurities that exist, but they do finance projects for commercial premises for rent. He explained that the lack of clear rules is reducing the dynamism of rental businesses and there are real examples such as in Colombia and Peru in which an eviction law has positive impacts.

Meléndez indicated that the draft rental law was presented last year and expired and this year a new version was re-introduced and they are concerned because it does not include the observations made by the union.

For Acoprovi, the three key points that a Rental Law must include are: balance of rights and duties, that is, ensuring legislation that guarantees a fair balance of rights and duties between tenants and owners.

The second is speed in conflict resolution and the third is to encourage the rental market, promote supply, competitiveness and quality of the market to adjust prices and improve the housing supply.
