They tried to rob a food cart, they couldn’t and they were sentenced to eight months in prison

Judge María Iriarte sentenced three young people who tried to steal a food cart at night to eight months in prison. The convicts went around dawn and took pliers, two knives and a razor to be able to lift the plate of the cart, since it was closed. Two waited at the door and one dedicated himself to trying to beat the metal, but in the process he cut his finger.

Hearing the noise of the plates, the neighbors called the Police and caught them committing the crime. They had to transfer the injured person to the emergency room and then to the sectional. They seized a hair straightener, a lady’s purse and caravans inside their hats, which had obviously been stolen from other people.

The fact that they were repeat offenders, that they acted at night and in a group were aggravating factors in determining the sentence. The extenuating circumstance was that they admitted having intended to commit the crime. As a result of that, the judge determined that they should spend eight months in prison for attempting a very especially aggravated robbery.

The crime of theft (article 340 of the Penal Code) is punishable by three months to six years in prison. The fact that they did not commit the crime also brings it closer to the minimum sentence.

The lawyer of the convicts, Federico Fascioli, had previously appealed the Justice’s decision to keep them in preventive detention for three months on the grounds that it was excessive for the charge he was charged with.
