Through the bill that would reform the Law 41-08, of Public Functionthe Executive power proposes make the figure of the competition for admission to administrative career positions more flexiblewhich would be without opposition, as a transitional way for the employees who occupy those positions to be able to choose to acquire that status.
Also, it would eliminate the figure of temporary designation in positions of administrative careerthe limit of 55 years to enter that status and the internal competitions for promotions, would regulate teleworking Y proposes to give the salary 14 for public servants.
The initiative was submitted last Tuesday by the Legal Consultant of the Executive power, Antoliano Peralta and other officials in the Chamber of Deputies. According to the letter sent by President Luis Abinader to the President of the Chamber of Deputies, Alfredo Pacheco, it is an initiative that was presented to all sectors during the Dialogue for Reforms developed by the Economic and Social Council (CES).
According to article 115 of the piece, on contests without opposition, “public servants who, upon the entry into force of this law, hold career positions without having been granted the status of career servants, must submit to to a special competition process, without opposition in the positions they hold or in any other, so that they can, if they qualify, obtain career status.”
The piece establishes that in said contests without opposition, only active servants of the same institution who do not have career status may participate. In addition, it states, in paragraph III, that in order to apply this article, the MAP and the bodies and entities that are under the scope of this law, if approved, will have a period of five years to complete these contests without opposition.
A status for 10 years
Article 124 establishes that when they have completed 10 years of exercise, the employees of the administrative career they must be excluded from the System and must be compensated, pensioned or retired, as appropriate.
While those who occupy the positions of administrative careerwithout belonging to it, may remain temporarily for up to six months under the conditions approved by the MAP and that, after that period, the renewal of the temporary appointment will not be allowed.
Add among the benefits that public servants would have the 14th annual salary, which would be delivered in July of each year.

The bill provides that those who hold positions of trust with high-level officials may receive financial compensation equivalent to one salary for each year worked in said position, without the lump sum exceeding eight salaries. Also, it proposes to eliminate internal competitions for promotions in public institutions and proposes to increase from three to six the vice ministries of the MAP.
According to the MAP reports, in 2021, 78,919 public servants with a general and special administrative career had joined. In August 2020, the then Minister of Public Administration, Ramón Ventura Camejo, said that there were 94,000 administrative career positions out of the 180,000 positions with that vocation.
