He also had words against the lawyers of Juan Metralla: “The lawyers of René Villarroel, alias Juan Metralla, a human rights violator, together with the lawyer of the other sergeant who is convicted, Carlos Tapia, requested this week the possibility of surrendering themselves to the Justice”.

“It was a possibility that the old justice system gave them, so as not to be apprehended in their homes, that is, they acted cowardly until the last day (…) The information we have is that only Carlos Tapia entered the court, who is already held in Punta Peuco to serve his sentence,” he added.

“Facilities like these that have been granted to human rights violators, apart from going to privileged prisons like Punta Peuco, re-victimize our families,” he concluded.

Case

On December 2, 1973, in the northern sector of Frutillar, Los Lagos region, former Carabineros officers, Carabineros René Isidro Villarroel Sobarzo and Carlos Segundo Tapia Galleguillos, fired shots at the former socialist deputy, Luis Espinoza Villalobos (36 years old), who was taken to the Valdivia prison after the coup d’état on September 11, 1973. Where he was taken on September 26 of the same year to be transferred to Puerto Montt, to the Chin Chin prison. The next day they took him out again to be handed over to the Carabineros, after being convicted of the crime of contempt, even though he had already been detained.

According to witnesses to the event, Espinoza was transferred to a headquarters of the Investigative Police (PDI) to be transferred on December 2, 1973 to the Second Police Station of the same city.

As reported at the time by the newspaper The Llanquihue There was a confrontation between the vehicle that transferred Espinoza and another, which caused the former deputy to take the opportunity to flee. Faced with this action, the shots were fired to repel the escape. However, connoisseurs of “Juan Metralla” indicate that he was a fan of shooting at the population as a form of intimidation, hence the nickname.

This year in a unanimous ruling, the Second Chamber of the Supreme Court rejected the appeals and the application of the “half prescription” requested by the defense of the two former officers. Finally, the highest court confirmed the sentence challenged in the first instance by the minister Alvaro Mesa Latorre in January 2019. This first sentence was 18 years in prison, but it was lowered after a resolution of the Temuco Court of Appeals in September 2019, it was this sentence that incurred the request for cassation, which was rejected this year .
