The Permanent Criminal Chamber of the Supreme Court “approved” the resolution issued by provisional supreme judge Juan Carlos Checkley in which he flatly rejected a challenge presented by the legal defense of Betssy Chavez for said magistrate to withdraw from this criminal process due to an alleged lack of impartiality.
Thus, the magistrate will continue in the process against Chávez Chino for his alleged participation in the failed coup d’état of December 7, 2022.
It should be noted that the defense of the former premier requested the “inhibition” of the magistrate on September 26, when said magistrate was going to evaluate the fiscal requirement to expand the rules of conduct imposed on Chávez in the criminal process so that he would not attend any of the embassies located in Lima, not communicate with ambassadors, ministers, presidents or any politician of a foreign country, as well as not communicate with his co-defendants and witnesses in this case and that the payment of a bond of 20,000 soles be set.
The legal defense of Betssy Chávez stated that they have doubts about the impartiality of Checkley Soria, which is why they requested to withdraw from the criminal process against the former minister, recalling the sentence issued by the Constitutional Court in which it ordered the release of their client, after annulling the judicial resolution issued by said magistrate, on December 27, 2024.
However, the supreme court determined that sufficient factual and objective elements were not found to determine the impartiality of the challenged magistrate, which is why it remains in the process against the former premier.
It should be remembered that Betssy Chávez was already sentenced by the Special Criminal Chamber of the Supreme Court to 11 years, 5 months and 15 days in prison for the crime of conspiracy to rebel and her location and capture were ordered nationally and internationally.
