According to the writings presented to the JEE, they all agree on the same thing: the exclusion of Vizcarra of the presidential formula of the political party of Peru Primero, because it stated in its Affidavit of Resume (DJHV) who was sentenced in October 2005 to a suspended sentence for the crime of embezzlement.

The three citizens alleged that, according to the Organic Law of Elections (LOE), a person who has a conviction in his or her record cannot be a presidential candidate in a popular election.
It is necessary to highlight that article 107, paragraph j, of the Organic Law of Elections (LOE) establishes the following for convicted persons:
“Persons who, due to their status as officials and public servants, are sentenced to imprisonment, effective or suspended, with a consented or enforceable sentence, for the commission, as perpetrators, of intentional crimes of collusion, embezzlement or corruption of officials; even if they have been rehabilitated.”
The first strike submitted last Monday, December 29, was declared inadmissible by the JEE because proof of payment for the appeal was not attached. Therefore, the citizen was given one day to correct said material error. After that, the electoral body will evaluate the citizen’s request.
They presented three strikes against Mario Vizcarra for having recorded a sentence for embezzlement on his resume.
