This Monday was the second day for the presentation of impediments before the Nomination Commission in charge of the process and Porras accumulates several, as confirmed by the prosecutor Mario David Aguilar, who made the complaint against the also Head of the Public Ministry (MP).
According to Aguilar, the official lacks honorability, is singled out for the alleged plagiarism of her doctoral thesis and violating the rights of the MP’s staff, as well as for her inclusion on the Engel List of the United States.
Eleonora Muralles, from the Projusticia Movement, joined these accusations, in particular the lack of suitability and honorability, essential requirements established by the Postulator to opt for the key position in the justice system, she said.
In Muralles’ opinion, Porras has shown that his actions against the MP and his efforts are focused on covering up people or some sectors that promote criminalization.
“The Prosecutor has participated in undermining democratic processes and institutions and has obstructed corruption investigations in Guatemala,” he pointed out in his argument.
Other aspects point to its role in the weakening of the Special Prosecutor against Impunity and its functions, and the loss of specialization in prosecutors such as Human Rights, environmental crimes and against Corruption.
The current Attorney General of the Nation, Jorge Luis Donado Vivar, is hot on the heels of Porras in terms of blemishes, who is involved in the defense of a person linked to the Mendoza Matta family and is accused of committing the crime of perjury.
This is stated in the brief delivered by José Figueroa to the Nomination Commission, which contradicts his statement under oath that he did not defend drug traffickers.
Muralles also took action against Donado, considering that he is neither fit nor honorable to take the reins of the MP, failing to fulfill his duties in the current position and highlighted four specific cases.
Figueroa also questioned the candidate Oscar Dávila, head of the Presidential Commission against Corruption, for not having the required 10 years of professional practice (he credited only nine years and six months).
Likewise, evidence was delivered against two other candidates of the 15 who passed the first filter of the election process opened on January 31.
Tomorrow the stage of strikeouts will conclude and on Thursday the 17th the commissioners will meet to learn about them and decide if they all continue in the race or one leaves.
The Postulator will have until April 21 to present to President Alejandro Giammattei a final list of six names, from which Porras’ replacement will come.
