The Avanza País bench, at the initiative of the congresswoman Patricia Chirinos, presented a bill that proposes that the President of the Republic may be accused during his term of office for corruption and other crimes.
It’s about the legislative initiative 1204/2021-CR, which proposes to modify article 117 of the Political Constitution of Peru in the following terms:
“The President of the Republic can be accused, during his term, of treason against the country; for preventing presidential, parliamentary, regional or municipal elections; for dissolving Congress, except in the cases provided for in article 134 of the Constitution, and for preventing its meeting or functioning, or those of the National Elections Jury and other electoral system bodies. Likewise, he can be accused, during his term, for the imputation of serious crimes related to acts of corruption, drug trafficking, violation of human rights, or for serious infractions of the Constitution.”.

The explanatory statement details that although the Constitution has opted for a parliamentary presidential model, in which the figure of the president is free from political responsibility, it has left “An empty space” against serious accusations that make his permanence in office incompatible.
Also, it is noted that “It is not reasonable in the face of the imputation of serious crimes or infractions of the Constitution that the accused (President of the Republic) continue in the exercise of the position”.
Thus, the author of the bill states that “the most powerful person” can go unpunished in the face of serious conduct, since waiting for the end of the mandate can affect the interests of the country.

“For this reason, the constitutional reform project aims to regulate a political trial procedure for the President of the Republic so that he responds during his mandate to the serious charges that may affect the exercise of his function”, narrowed down
