The Justice ordered this Friday to analyze the messages of two advisors to PRO deputy Gerardo Milman from July 1 to December 1, 2022, in relation to the lead that investigates him in the case of the attempted murder of Vice President Cristina Fernández de Kirchner, on September 1.
The decision was made by the Federal Chamber of Buenos Aires, which ordered to extend the time period for the analysis of the cell phones of Milman’s advisers, by making room for a complaint by the Vice President, according to the resolution to which Télam had access.
The Court of Appeals revoked a decision by federal judge María Eugenia Capuchetti, in which she refused to extend the period of expert analysis, limited by her to the days after August 30.
On that date and two days before the assassination attempt, a witness declared having heard Milman say in the Casablanca bar, near the National Congress, “when they kill her, I’m on my way to the coast.”
Milman denied having made that comment and two advisers who admitted to having been with him at that time in Casablanca, also denied in court having heard him say those words.
On December 1, both appeared in the federal courts of Retiro to expand their statement and handed over their cell phones, but one of them, Carolina Gómez Mónaco, told prosecutor Carlos Rivolo that she had changed the device.
The other, Ivana Bohdziewicz, told her that she had deleted all the messages, including her conversations with Milman.
“I want to clarify that I deleted them. Both the messages and the photos, because I felt that my privacy could be violated if they asked me for my phone number. I deleted everything because there was no possibility of selecting only a few things and I had compromising intimate photos of myself. For that advised,” he said in that December statement.
The statements were made within the framework of the so-called “Milman Clue”, in which it is being investigated whether the JxC deputy was actually aware that on September 1 there would be an attack on Fernández de Kirchner in the vicinity of his apartment in the neighborhood Recoleta porteño.
The complaint appealed to the Federal Chamber, which now ordered the “extension of the proposed time period” for the information extracted from both phones to be analyzed from July 1 to December 1, 2022.
The decision was made by chambermaids Leopoldo Bruglia and Pablo Bertuzzi, with the dissent of the third member of Chamber I of the Court, Mariano Llorens.
The expertise must be carried out “as the complaint itself has suggested, under precise jurisdictional control and the Public Prosecutor’s Office and with restriction of absolute confidentiality of all information that is not strictly related to the case,” the judges warned.
“Taking into account the guidelines drawn up and the institutional seriousness of the fact investigated here, it becomes necessary to produce the evidentiary procedures that may be relevant and useful for the investigation of the truth, sparing no effort and with the urgency of the case,” they highlighted. Bruglia and Bertuzzi.
Based on this, “it seems reasonable that the search for the information contained in the telephone sets seized from Ivana Bohdziewicz and Carolina Elizabeth Gómez Mónaco be carried out, which must be confined to corroborating or ruling out the existence of any mention of the statements that, according to the witness,” Milman said.
The expertise should also address “any mention or text that can be linked to the attack,” they resolved.
All the available information was extracted from both devices, but the period of its analysis was limited and that was what the complaint questioned.
Disagreeing, Judge Llorens voted in a minority to confirm Capuchetti’s decision.
“The party was unable to adequately substantiate the requested extension, especially when, at the hearing itself, both lawyers warned of the uselessness of the requested evidence due to their suspicion that the content of one telephone device would have been erased while the other would have been changed for his user. In this context, the arguments of the Complaint -for the moment- seem abstract and devoid of objective meaning, “he argued in his vote.
The material author Fernando Sabag Montiel, his girlfriend Brenda Uliarte and a third defendant, Gabriel Carrizo, are being arrested and prosecuted for the attempted murder of the former president and current Vice President.
