Toluca, Méx., After 31 years of the murder of Luis Donaldo Colosio, a federal judge yesterday issued a formal prison order against Jorge Antonio Sánchez Ortega, former agent of the extinct Cisen, accused by the authorities of being the second shooter in the assassination of the former PRI presidential candidate.

With this determination, the man opened criminal proceedings for qualified homicide for the events that occurred on March 23, 1994 in Tijuana, Baja California, judicial sources indicated. Sánchez Ortega will remain held in the Altiplano federal prison, in the state of Mexico, where he has been for a week after being detained again in Tijuana due to the proceedings opened against him by the Attorney General’s Office (FGR).

The former agent appeared this Saturday before the fourth district judge in criminal matters in the state of Mexico, Daniel Marcelino Niño Jiménez. The judge considered the elements presented by the Public Prosecutor’s Office to be sufficient to order the formal imprisonment, a decision adopted in the practice grid because the file – the preliminary investigation SE/003-BIS/95 – was integrated under the old inquisitorial criminal system.

The resolution was issued after Sánchez Ortega requested the extension of the constitutional period of 72 hours to define his legal situation, which expired yesterday.

In September, Judge Niño Jiménez himself had issued the arrest warrant for qualified homicide. The capture took place, according to the National Detention Registry, at 4:37 in the afternoon of November 8, in the Los Reyes neighborhood of Tijuana.

Sánchez Ortega had been arrested for the first time in Lomas Taurinas, Tijuana, where Colosio was murdered. At that time, the evidence to document his participation in the crime was that his jacket was splattered with the presidential flag bearer’s blood and that the rodizonate test – used to identify people who have used a firearm – came out positive.

However, the then Attorney General’s Office (PGR) released him the next day, after it was determined that the weapon that had taken Colosio’s life was the one Mario Aburto was carrying.
