The Anti-Corruption and Good Government Secretariat imposed a new sanction on the pharmaceutical company Loeffler, SA de CV, consisting of a fine of 128,255 pesos and a three-month disqualification from participating, by itself or through intermediaries, in contracting procedures or entering into contracts with the federal government.
According to the information published yesterday by the agency, the measure was applied through the Internal Control Body in the Institute of Security and Social Services of State Workers (Issste) as part of an administrative sanction file for bidders, suppliers and contractors of 2021 (SAN-011/2021), due to non-compliance with contract 190214 ME, derived from the non-delivery of 5,320 containers of the key 010.000.105.00 at the National Distribution Center.
The sanction was notified on October 3 and published yesterday in the Official Gazette of the Federation (DOF). With this, the company was registered in the Directory of Sanctioned Suppliers and Contractors. The Secretariat specified that the resolution was issued in accordance with the parameters established in the Law for the graduation of sanctions, and recalled that Loeffler has the right to challenge the determination.
The new resolution occurs one day after the same agency reported the cancellation of another sanction previously imposed within the same file SAN-011/2021. In a circular published on Thursday in the DOF, The Secretariat reported that the Federal Court of Administrative Justice declared the nullity of a 45-month disqualification and a fine of 1.9 million pesos, issued in 2021 by the Internal Control Body of the ISSSTE.
That judicial resolution, issued on April 28, 2025, partially recognized the company’s arguments regarding alleged irregularities in the administrative procedure SAN-011/2021, which led to the formal cancellation of the sanction on September 22.
With this new measure, Loeffler once again faces restrictions on participating in public procurement.
