La Lagunita Country Club agreed to expel Jaime Cárdenas, the young man on the autism spectrum whose family sued the aforementioned civil association because they prevented him from entering with his therapy animals, that is, two dogs and two horses.
The suspension measure is for a period of one year and includes the prohibition of entering the club, but must comply with all the pecuniary obligations established in the statutes.
The expulsion of Cárdenas and his family is considered “retaliation for having introduced an appeal for protection aimed at restoring Jaime’s rights,” explained Juan Ernesto Garantón, the victims’ lawyer.
Motivated by this, Garantón reported this situation to the National Council of People with Disabilities. ”They (La Lagunita) recognized in a letter that Jaime Cárdenas has the status of an affiliated member because he has a special condition. They violated that; because first they excluded him and then his family,” Garantón explained.
Here are the details of the amparo appeal filed to achieve the restoration of the rights of Jaime Cárdenes, who was prevented from entering the facilities of the Lagunita Country Club with his assistance animals.
- September 2025. The board of directors of the Lagunita Country Club prohibited member Jaime Cárdenas from accessing its stables, who suffers from the autism spectrum and required therapy with the two Mini Horses, among others.
- November 2025. The 27th Ordinary Municipal Court and Executor of Measures of the Judicial District of the Metropolitan Area of Caracas carried out an inspection of the stables of the Lagunita Country Club Civil Association, ”in which several facts were recorded that undermine the constitutional rights of Jaime Cárdenas,” says lawyer Juan Ernesto Garantón.
- December 2025. On December 16, the Ninth Civil Court of the Metropolitan Area of Caracas admitted the appeal for protection filed by the Cárdenas family motivated by “discrimination and intolerance against a person on the autism spectrum and his family.”
- December 2025. The Ninth Civil Court of Caracas issued precautionary measures in favor of Jaime Cárdenas. The ruling, identified under file AP11-0-FALLAS-2025-000113, orders the La Lagunita Country Club Civil Association to cease preventing access to the assistance animals necessary for the treatment of Jaime Alfredo Cárdenas Echenagucia, a young man with autism spectrum disorder (ASD). The court noted that, if it did not act, there was a risk of causing “damage that is difficult or impossible to repair” to the health and well-being of Jaime Cárdenas, prioritizing the right to health over the statutory regulations of the civil association.
- December 2025. Ninth Civil Court of Caracas held a hearing to decide the merits of the protection exercised by the Cárdenas family. At that hearing, the Public Ministry requested that the rights of Jaime Cárdenas be respected and consequently urged the Lagunita Country Club to make reasonable adjustments to its bylaws. The Court declared the protection inadmissible but left alive the precautionary measure that prohibits the Lagunita Country Club from preventing access to Jaime Cárdenas to carry out his therapies.
