Two new complaints have arrived against the members of the commission in charge of choosing Gino Ríos Patio as president of the National Justice Board (Jnj). These are those presented before the Congress of the Republic and the Prosecutor’s Office For the citizen Tito Esteves Torreswho also nominated the position in the Jnj.
The commission in charge of the election of Patio rivers It was made up of Josué GutiérrezOmbudsman; Luz PachecoPresident of the Constitutional Court; and other members such as Javier Arévalo, Juan Carlos Villena and César Aguilar. In this way, those mentioned would be achieved by the resources presented. These complaints seek to declare the nullity of the selection process, by which Ríos Patio was elected as president of the institution and that a new contest is convened.
According to the documents presented, Esteves accuses the members of the commission of having violated the constitution and current regulations by designating as a titular member to Patio riversalthough this has a criminal record for family violence. This, he maintains, contravenes the legal requirements to integrate the National Justice Boardwhich requires not having firm convictions.
Now, the constitutional complaint will have to follow its corresponding process before the Subcommission of constitutional accusations (SAC). In the same way, it will be the responsibility of the Prosecutor’s Office to decide if the preliminary proceedings are initiated to corroborate the information presented in the aforementioned complaint.
They denounce partialization in the election of the members of the JNJ
The complainant points out that he was unfairly disqualified in the final stage of the contest, despite having obtained good scores and not having a history, which would evidence a partial and arbitrary evaluation. Therefore, he has requested that the members of the Commission for crimes be criminally investigated as omission of functions, influence peddling and generic falsehood, and that Congress evaluates its possible constitutional infraction.
“My interest is not personal against any chosen member, but is based on the inequality of treatment that has existed throughout the process. This is evidenced in the fact that a candidate with criminal and/or judicial records has been appointed. He declared not suitable in the interview, in which I was also asked questions without any livelihood, “said the complainant to the Republic.
The sentence for family violence against Gino Ríos
Gino Ríos Patiocurrent president of the National Justice Board (JNJ), was sentenced in 2011 for repeated psychological abuse. Despite this antecedent, he exceeded the selection process without his history being questioned, even when the Organic Law of the JNJ prohibits people with convictions for family violence from accessing the position. The Special Commission, led by the Ombudsman, Josué GutiérrezHe did not address the issue in the final interview.
During the evaluation, Javier Arévalothen president of the Judicial Branchled the interview and focused on a complaint filed for corruption, ignoring the sentence for violence. Although the victim’s lawyer presented a formal torch, this was dismissed for appearing outside. Ríos never directly explained his conviction and just described it as a “conjugal conflict.”
The testimony of his ex -wife, included in the sentence, details threats and pressures linked to food demands. However, no member of the commission demanded clarifications. Gutiérrez justified the omission pointing out that they did not want to invade Ríos’s personal sphere. He also claimed that the conviction does not disable it, although the law in force at the time of the contest did expressly prevented it.
