Santo Domingo. – The ninth Criminal Chamber of the Court of First Instance of the National District sentenced a year in prison and the payment of a fine of fifty minimum wages to Dahiri Miguel Espinosa Guerra, former director of Information Technology of the General Directorate of Government Ethics and Integrity (DIGEIG), for the massive elimination of sensitive data of that state entity.
Espinosa Guerra was found guilty of damaging and altering computer records in its quality of public servant, in violation of article 10 and its paragraph of Law 53-07 on high-tech crimes and crimes.
During the trial, the Public Ministry, represented by litigating prosecutor Merlin Mateo Sánchez, showed that the accused deliberately erased a total of 377,969 records institutional After July 5, 2020 date of the national elections.
Among the deleted files were found:
- SAIP Platform of Complaints and Access to Public Information;
- Sysplan institutional strategic planning system;
- IPAC folder linked to an anti -corruption participatory initiative backed by the UN.
The accusation was presented by the Specialized Attorney’s Office against Crimes and Crimes of High Technology (PEDATEC), headed at that time by the current attached attorney Iván Féliz Vargas .
The sentence orders that Espinosa Guerra serves the sentence in the Najayo Men’s Correction and Rehabilitation Center constituting a relevant precedent in the fight against technological crimes within the public administration.
