The Duartian Institute and the Permanent Commission of Ephemeris Homelands complained today to the Public Ministry against an LGBT collective that published a lesbian version of the national anthem.

The Duartian Institute, represented by its president, Wilson Gómez Ramírez, deposited the complaint in the National District Prosecutor’s Office.

Meanwhile, Efemérides Patrias, represented by its president Juan Pablo Uribe, deposited it in Attorney General’s Office.

Both entities claim penalties against Mrs. Yoseli Castillo Fuertes and others involved.

They requested that the Public Ministry and Justice act quickly and rigorously to sanction the fact, which qualify as a serious offense to historical memory, national sovereignty and national symbols.

Both entities argued that, although the Constitution of the Republic protects freedom of expression, it must respect the honor, dignity and integrity of national symbols, as established in article 33 of the Magna Carta and Law 210-19 on the correct use of national symbols.

This law sanctions the outrage with sentences of one to three months in prison and considerable fines, while Law 53-07 on high-tech crimes and crimes aggravates the situation as the alteration by electronic means have been disseminated.

Wilson Gómez stressed that the Duartian Institute will seek to apply the maximum sanctions, including up to one year in prison and fines of five hundred times the minimum wage, to reflect the severity of the crime committed.

For his part, Juan Pablo Uribe requested the immediate suspension of the reproduction or dissemination of the altered version of the national anthem and the identification of all those responsible, emphasizing that the complaint is made in defense of the constitutional order, the historical memory and the patriotic values that base the nation.

Both institutions reiterate their commitment to the defense of national emblems and call for justice to impose exemplary sanctions and prevent similar acts from being repeated, thus protecting the respect that the national anthem and its authors deserve.
