Judge Edward Abreu Acevedo, of the Execution of the Sentence of the National District, was challenged this Tuesday by the victim’s bar so that he does not continue with the hearing where the process against the former Major League player, Miguel Tejada.
The defense of Henry Soto, to whom Tejada owes approximately nine million pesos, indicated that he requested the recusal because his client, who is a lawyer, had had legal cases against the parents of Judge Abreu Acevedo.
“We realized yesterday, especially in response to the victim’s suggestion, that as a lawyer, in the past, he had had cases with which he had confronted the judge’s parents,” explained lawyer Rafael Rivas Solano.
Now it will be up to the Court of Appeal of the National District to reject or approve the petition against this judge.
The recusal within procedural law is a form of removal of a judge from a process, when a party considers that his impartiality is not guaranteed.
As explained by the lawyers of the plaintiff Henry Soto Lara, the former baseball player owes him about 9 million pesos. In this regard, Soto Lara said that Tejada promised to pay the money but that he has not complied with this.
Regarding the complainant, Miguel Tejada’s defense said that this is a lawyer who claimed the debt of a deceased person.
“That is an invention. There is the sentence and I am alive. It’s a joke in bad taste,” replied Soto Lara.
Judicial process against Miguel Tejada
This Tuesday the judge wanted to hear the hearing against former baseball player Miguel Tejada in which he was going to decide whether to execute or suspend a sentence imposed on him for issuing a bad check.
The sentence, in which he was sentenced to six months in prison and payment of the debt, was issued in 2017, but has not been carried out because it was appealed in several courts by Tejada’s lawyers to suspend it.
According to what was explained by the lawyer José Martinez Hopealman, the former baseball player was arrested last Thursday, because the plaintiff (to whom Tejeda owes him), took the sentence to the General Directorate of Migration.
It is there, that he indicated he was arrested in the Las Americas International Airport (AILA), even without being summoned for the execution of the sentence. Since then, the former Major League Baseball player has been detained.
