In its request, the union recalled that its initial request was presented on November 13, 2023 and that since that time the TC has not ruled.
The first request sought to annul Articles 1 and 2 of Law No. 31388, which extended the Reinfo until December 31, 2024.
Now, because Parliament extended the deadline again, through Law No. 32213, the bar association asked the TC to extend the application of the demand to this latest decision of the Legislature for repeating the same “vices of unconstitutionality.” ”.
“What we are looking for with this request is that the TC does not have the excuse of saying that, as time has passed, the first lawsuit has already expired and has nothing to resolve, and does not speak out, leaving the issue without a solution,” he explained. the lawyer Samuel Abad to Peru21.
Abad, legal representative of the union members, said that it is necessary for the highest interpreter of the Magna Carta to issue a resolution and resolve the dispute because, otherwise, the Legislature will continue to approve the extension.
The Reinfo is a permit that allows informal miners to formalize themselves within a period of time. However, in practice, they continue to carry out illicit activities, such as mining and the use of explosives, without any control.
