The case became public after the Prosecutor’s Office, represented by the prosecutors; Ysaac Ferreira, Fabiola Molas Alcaraz, Eduardo Royg and Deny Yoon Pak, will present as evidence wiretaps obtained illegally by the Brazilian Federal Police.
The context is as follows; The Brazilian Federal Police entered Paraguayan territory in 2018 to tap cell phones, take photographs of private documents (ANDE, ESSAP invoices, private contracts, etc.) and map real estate. This, without any authorization from the National Congress, which is the only one that can authorize these operations.
The case is against Robson Alcaraz Ajala, the sentimental partner of Isaura Sanches Freitas. He himself was declared in absentia at the moment.
The argument of the Public Ministry is that the punctures are guaranteed under an International Legal Cooperation. However, article 4 of the United Nations Convention against Transnational Organized Crime (Vienna Convention) mentions that a State party may not exercise, in the territory of another State, functions that the internal law of that State reserves exclusively to its authorities. .
PREVENTIVE PRISON
Edgar Arias, defense attorney, requested on Tuesday the preventive detention of his client. So that she fulfills it in a house located in the city of Capiatá, considering that she is a native of Pedro Juan Caballero.
This request is being analyzed by the guarantee judge Gustavo Amarilla. It should be remembered that the woman has been detained for 15 months in the Encarnación Regional Penitentiary.
At the end of last year, the prosecutor’s office asked his Brazilian counterpart for all the records he had on Sanches Freitas. However, no criminal record was found in the documents submitted. This was submitted on December 30. Therefore, the defense requests preventive detention.
To this is added that the woman suffers from stomach diseases such as spinal injuries, which cannot be treated from her place of imprisonment.
INTERNATIONAL AID
Finally, Arias asked the foreign and national authorities to intercede for Isaura, since she is a mother of three minor children. He was referring specifically to the American embassy, the authorities of the Catholic Church or the representative of human rights.
“The background to the issue is that the prosecution did not arrest Robson. So that’s why they punish the lady. There are no items, accounting came out perfect. We ask for the intervention of the American embassy because they are defenders of human rights. They always seek transparency and justice”, he concluded.
