The Ministry of National Assets reported on the eviction of the public house located at Calle Los Prunos 7211, in the commune of La Reina, “in compliance with a ruling by the courts of justice that determined that the people who inhabited it are ‘illegal occupants ‘ and ordered the restitution of the property on August 10, 2021.”
The Secretary of State indicated that, after numerous conversations with the occupants and their family, successive extensions have been granted for the voluntary restitution of the property. The last one, on July 4 of this year 2022, when they promised to abandon it within 30 days, which did not happen.
It is worth mentioning that the Los Prunos house is a property of the Treasury, measuring 833 square meters, with a tax valuation of more than 230 million pesos, in which the Miranda Araya couple have lived since 1973.
Indeed, after arriving at this fiscal house in 1973, Mr. Manuel Miranda leased it until 1980. In 1983, the State granted him the possibility of purchasing the property, which was not materialized because the interested parties never presented the necessary documents or background information.
In this way, according to the Ministry of National Assets, they continued to live for free until 1991, when a new rental contract was signed with Mrs. María Teresita Araya as owner. However, this lease was only paid until 1992. As a result of this breach, a payment agreement was signed in 2001, whose installments were only paid until 2004.
“Since 2005, the situation has been judicialized and the courts have rejected the claims of the occupants. Despite the appeals filed by the couple before the Court of Appeals and the Supreme Court, the ruling favorable to the Treasury that orders the restitution of the property. Although various opportunities and new deadlines have been granted for voluntary restitution, this has never been fulfilled, leaving no other option than the eviction that took place today,” they detail from National Assets.
Although the Miranda Araya couple correspond to older people, they would be far from being in vulnerable conditions, they have economic resources and a support network, both family and social, as verified by the competent organizations in this matter.
Manuel Miranda was an official and later Seremi of National Assets of the Metropolitan Region between 1992 and 1994. “As a Ministry we declare that the fact of having held a public office, under no circumstances can enable a use of fiscal assets, nor legitimize the extension of a privileged situation that the rest of the citizens do not have”, sentenced from National Assets.
The recovery of the Los Prunos house will allow the Ministry of National Assets to make available a property of more than 800 square meters to satisfy social needs in the commune of La Reina, thus fulfilling the mandate of making good administration of the tax real estate.
