They admit lawsuit against Miniguality for its possible fiscal impact

In the last few hours, the Constitutional Court, during the presentation by magistrate Alejandro Linares, admitted a lawsuit against Law 2281 of 2023, with which the Ministry of Equality and Equity was created under the leadership of Vice President Francia Márquez.

According to information from ‘W Radio’, the lawsuit was filed by congresswoman Paloma Valencia on the grounds that would have been unaware of the fiscal impact of creating this ministry.

Along with this, the congresswoman from the Democratic Center argues that there were procedural defects since the necessary quorum was not met, presumably in the First Committee of the Senate to be approved in the first discussion.

Only nine of the 21 senators on the commission were present at the time.

The demand also reproaches the extraordinary powers of the President of the Republic, Gustavo Petro. The document was also signed by other congresswomen such as María Fernanda Cabal and Paola Holguín.

“Neither the presentation report for the first debate nor the articles could be approved by ordinary vote, but a nominal vote was required, because (i) only through this was it possible to certify that the vote complied with the absolute majority required for its approval; and (ii) the opposition had announced that it would withdraw from the venue at the time of voting on the project, which is why it was necessary to call for a nominal list to verify if there was the necessary decision-making quorum to approve the initiative,” says the document.

During the debate, the speaker Alexander López assured that the government project had not estimated how much it would cost to create a ministry.

It should be remembered that the Ministry of Equality was one of President Petro’s campaign promises. A commitment to women and populations that historically They have been discriminated against such as Afro, indigenous and poor.
