The Second Constitutional Court of Lima admitted for processing the habeas corpus petition presented by the lawyer Marco Riveros Ramos in favor of the sister-in-law of President Pedro Castillo, Yenifer Paredes. The claim of the lawyer is to declare the nullity of the process followed against the sister of first lady Lilia Paredesincluding the order of preventive detention for 30 months.
Riveros Ramos requires the constitutional justice to annul the provisions issued by Judge Johnny Gómez Balboa, of the Third Preparatory Investigation Court, because, according to him, the process against Paredes Navarro should be processed before the Supreme Court.
“In the case of Yenifer Paredes, the natural judge who must resolve the case and any incident that occurs in it (…) corresponds to the Supreme Judge of the Preparatory Investigation who hears the criminal proceeding against Mr. José Pedro Castillo Terrones, President of the Republic of Peru, who is accused of being the leader of a presumed criminal organization”, alleges the former legal defense of Gerald Oropeza.
The lawyer argues that “by simple logic we would be facing a case where there are two prosecutors, two judges who know the same and only alleged criminal organization, according to the prosecution.” For this reason, he cites article 44 of the New Code of Criminal Procedure, which establishes that unregistered persons who would have participated in crimes committed by high-ranking officials “will be prosecuted before the Supreme Court of Justice together with them.”
“The natural judge is Mr. Juan Carlos Checkley Soria, supreme judge of the Supreme Court of Preparatory Investigation, in charge of the file and, as is logical, his peer in the jurisdictional line is the prosecutor of the Nation, who is the head of the criminal action. in those jurisdictions who should act, ”says Marco Riveros Ramos.
In the event that his main claim is dismissed, the lawyer assures that there is another reason to annul the process, but only in part: the intervention of Judge Justiniano Romero Raúl Wensislao, of the Eighth Preparatory Investigation Court, who is the “investigation judge preparatory school that has to know the process from the beginning of the preliminary proceedings until the issuance of the resolution that dismisses or dictates the order of prosecution.
Seeks to go to the Inter-American Court
Lawyer Marco Riveros Ramos considers that due to “political biases and media pressure” his appeal could not prosper “so it is appropriate that the Inter-American Court of Human Rights hear this outrage.” He says that Yenifer Paredes is being prosecuted for being a relative of President Pedro Castillo. “Absolutely clear political discrimination,” he says.
