The Public Ministry charged Judge Rafael Alcón with breach of duties, prevaticato and destruction of documents. He obtained preventive detention for six months, but the defense will appeal this determination because it threatens the health of the accused.
The accusation, signed by three prosecutors, justifies the request for preventive detention in the La Paz prison, pointing out, among other things, that Alcón gave a false address when he gave his informative statements after his arrest.
This argument was refuted by the defense, which argued that the judge has a family and a profession, but it did not prevent him from being detained in the San Pedro prison. For this reason he will file an appeal.
“Unfortunately, an unfounded resolution was issued. For this reason, it forced us to file a precautionary appeal. The arguments of the Public Ministry were obviously not enough, however, and heeding the accusation by the jurisdictional authority, preventive detention was ordered, “said the defense attorney, Jhonny Morales.
The professional added that an appeal was filed that will suspend Alcón’s transfer from the judicial cells to the San Pedro prison. “By ordering the preventive detention of our defendant at any time he could be sent to prison,” he said.
The defense also requested that this measure be annulled considering the situation of Judge Alcón, who would have denied release from the prison to several prisoners, and due to the state of health of the accused.
