On June 9, the European Parliament approved a resolution that seeks to punish Ortega judges and magistrates for considering that they are “responsible for the repression.”
The three magistrates who could be included in the “black list” of the European Union (EU) have rejected appeals filed by the defenders of political prisoners.
The resolution was supported with 524 votes in favor, 17 were against and there were 29 abstentions. It is the fifth proposal on Nicaragua in this legislature. MEPs denounced the abusive detention, the lack of procedural guarantees and the illegal convictions of political prisoners that have occurred in the Central American country.
The judges of the Court of Appeals of Managua (TAM) proposed to sanction are Octavio Rothschuh Andino, Ángela Dávila and Argentina Solís, who “have also participated in the deprivation of procedural and material rights,” says the EU.

Rothschuh Andino serves as president of the Criminal Chamber One of the Court of Appeals where they are currently ratifying the sentences against the political prisoners of the regime. The Ortega official has 28 years of experience and assumed his position as president of the TAM on July 2, 2021.
«It is an honor for me to have the support of doctors Angelita Dávila and Rosa Argentina, two great ladies of the administration of justice. I am not going to disappoint the vote of confidence that they have given me,” said Rothschuh after being appointed by Solís and Navarrete.
Rosa Argentina Solís was appointed as a magistrate of the Criminal Chamber Number One of the TAM on October 16, 2018, her swearing-in was in charge of Alba Luz Ramos, president of the Supreme Court of Justice. Solís was appointed in that context without being an official of the Power
Judicial.
On the other hand, Ángela Dávila had held the position of president in the oppressive organ of the regime for two years to later be replaced by Judge Rothschuh. The lawyer has been in the positions of the Judiciary for 40 years, first she served as a local judge in Managua and 15 years later she was promoted to a district court, where she was for 5 more years with the extinct Criminal Instruction System, for currently be one of the three key pieces of the regime in court.
The three officials have also been singled out for ordering the release of Pierson Gutiérrez Solís, who in 2018 shot and killed the Brazilian student, Raynéia Gabrielle Lima. The defendant was released under the controversial Law 996, also known as the Amnesty Law.

They ordered to cancel the criminal record that the confessed murderer had for this case. Pierson Gutiérrez Solís took the life of the young woman of Brazilian origin, on the night of July 23, 2018, in the surroundings of the Totonda Universitaria, when the student was returning home, after doing her shift at a hospital in Managua.
The European Union points out that “the Nicaraguan courts have dedicated themselves to handing down absolutely disproportionate sentences against political prisoners, in processes that are clearly corrupt and that offered no guarantees of transparency to the accused persons. For this reason, this resolution, and it is what we have to focus on, asks for sanctions for the judges, since they are helping Ortega to execute that repression»
In all its resolutions, the Europarliament has demanded the release of political prisoners. In the recent text, they call for “immediate and unconditional release of those detained since April 2018 and annul the judicial proceedings against them, and allow a safe return of all refugees and exiles.”
