There is independence in the new Court, says Hugo Aguilar in a 100-day report

Hugo Aguilar joins the rejection of retroactivity in Amparo Law

Before the Secretary of the Interior, Rosa Icela Rodríguez; the president of the board of directors of the Senate, Laura Itzel Castillo, and the vice president of the Chamber of Deputies, Sergio Gutiérrez Luna, the minister recounted the decisions made by the Plenary Session of the new Court, administrative and regulatory measures that, he maintained, already mark a difference with the previous integration of that body.

“We are convinced and determined to make a difference,” he said in a long message that he divided into 10 sections, with continuous references to the past period of the Court, which he considered “arrogance,” with slowness to resolve issues, with “privileges” and with excesses.

Accompanied by the eight remaining ministers, Aguilar Ortiz mentioned, for example, that there is already “real and true justice.”

“Today we can affirm with responsibility that we have a Supreme Court of Justice of the Nation willing to go beyond the files, beyond bureaucracy and indifference, to achieve justice that transforms the lives of people, communities, groups and in general the life of our country,” he stated.

“Those of us who head this fundamental institution of the Republic are convinced and determined to make a difference. We did not come here to follow the same inertia, the same logic and the same rhythms. We are here to fulfill the mandate of transforming the Court and permeating the entire Judicial Branch. A justice that reaches everyone, without a doubt, will fulfill the democratic mandate,” he said.

“A justice that reaches everyone will undoubtedly fulfill the democratic mandate. A justice that listens to the people will never be selective, partial or popular. A real and true justice will be one that does not require an explanation to be understood and felt. That is what all our efforts are directed toward,” he added.

He explained that today there is a relationship with the other powers, but not subordination, and he was insistent on the issue. “In these first months we have made it clear that the Supreme Court maintains its institutional responsibility firmly. It does not respond to particular interests. It does not adjust to current pressures. It does not allow the political climate of the moment to distort its role,” he explained.

“This Court does not bow to any agenda outside the constitutional framework. Its only loyalty is to the Constitution and to the people of Mexico. We keep in mind that judicial independence is an essential element for the stability of the country. An independent justice system generates social and economic trust, allows conflicts to be resolved peacefully and contributes to democratic coexistence,” he said.

However, he admitted that there may be external pressures and they may be variable, “but the Constitution remains. And it is that permanence that must guide our decisions. Judicial independence means acting with serenity, even when the environment is complex.”

That is why he offered all sectors of the country judicial independence and at the same time called for national unity.

“May companies, universities, governments, communities, citizen groups and social organizations find in this Supreme Court a space for balance, dialogue and constitutional protection,” he said.

“To each Mexican we reiterate that this is their home. Here their dignity is protected, here their freedoms are safeguarded and here their voice is heard. To each sector of national life we extend a call to unity. Mexico needs us to work together, so that differences do not become barriers but rather opportunities to strengthen our democratic institutions.”
