The woman who insulted Francia Márquez pleads guilty

The Colombian Luz Fabiola Rubiano declared this Monday, April 10, cguilty of uttering racist insults against the Vice President of Colombia, Francia Márquez, and his sentence will be set on May 30 in Bogotá.

This was established during the indictment procedure in which the Colombian Prosecutor’s Office accused her of the crimes of acts of discrimination and aggravated harassment, that Rubiano accepted for having called Vice President Márquez, the first Afro-Colombian to reach that position, an “ape”.

The racist insults were uttered by Rubiano on September 26, 2022 in the Plaza de Bolívar in Bogotá, in statements that appeared in various media, during the day of protests against the Government of Colombian President Gustavo Petro.

Due to the foregoing, Judge 39 of the Circuit with the function of knowledge of Bogotá agreed with the parties that on May 30 will announce the conviction.

The crime of acts of discrimination could lead to a sentence of between 12 and 36 months in prison, in addition to a fine of 10 to 15 current monthly legal minimum wages. Aggravated harassment also contemplates a penalty of up to 36 months in prison. However, the “aggravated” component can increase the penalty for this crime.

In addition to making racist comments against the vice president, Rubiano also told a media outlet that “communists” should be killed.

The Colombian vice president said in October of last year that she would not reconcile with the woman considering that “conciliating and having it retracted does not prevent the rest of society from continuing to engage in criminal behavior such as racial hatred“.

A video of the woman went viral on social media for offending the vice president when she was interviewed on the steps of the Capitol during the demonstration against the political and economic reforms of President Petro.

“Blacks steal, rob and kill, what education do they have?” insisted the woman, who said she had gone to the protest against the reforms that the Petro government seeks to make and against those who “want to return to communist Latin America.”
